RELEASE AND PARTICIPATION AGREEMENT


Thank you for participating in a Havening Techniques Training ® Event (the “Event”) sponsored by the Center for Havening Research & Training, Inc. (“CHRT”) and presented by CHRT employees, staff member, representatives, and volunteers or sponsored and presented by an independent Certified Havening Techniques Trainer (“Trainer”), whichever is applicable (collectively “Presenters”).  By participating in the Event you agree to the following terms and condition:

  1. You understand by participating in the Event you will be learning about and using a group of innovative methods identified as the Havening Techniques (“Havening”) developed by Ron Ruden, MD, PhD in collaboration with his brother Steve Ruden, DDS. In addition to offering the Event to the general public, you understand the Event may also function as part of the curriculum required by CHRT for the Havening Techniques® Practitioner Certification Program (the “Program”).  Upon successful completion of all of the required courses and other requirements for the Program, you will have the option of becoming a Certified Havening Techniques Practitioner, granting you the right to identify and represent yourself as a Havening Techniques Practitioner.  You understand and agree that you may not represent yourself as a Havening Techniques Practitioner (certified or otherwise) or advertise that you use Havening until you have successfully completed the Program.   
  1. Havening can be described as a type of psycho-sensory technique based on the fields of neuroscience and neurobiology which uses sensory input in order to alter thought, mood, and behavior. It is believed that when an event or experience is perceived as traumatic or stressful it becomes immutably encoded in the psyche and the body, often with life altering consequences.  Havening is designed to make changes in the brain in order to de-traumatize and remove from both the psyche and the body the emotional memory of a traumatic or stressful life event and its negative effects.  Therefore, Havening is a healing modality that is designed to help individuals overcome problems that are the consequence of traumatic or stressful encoding and is comprised of protocols that use the sensory input of touch (“Havening Touch”).  Because touch can be a potential problem in doing healing work, if you have any misgivings, doubts, or any negative reactions to any physical contact it is very important that you let the Presenters know so that you can use self-touch when using Havening during the Event.
  1. Havening has three (3) distinct applications, one is for emotional disturbances, second is for wellness, stress management, and peak performance, and the third is as a self-help tool. Therefore, Havening can be used within a psychotherapeutic setting with professional mental health care clinicians that have been fully trained and certified in Havening.  In addition, Havening can be used by non-licensed practitioners as a protocol for coaching sessions, or as a tool in an allied health care practice by individuals that have been fully trained and certified in Havening.  Havening can also be used as a self-help technique and shared with family members and friends. If you choose to use Havening in a professional setting, you agree to only use Havening within your legally defined scope of practice. 
  1. Havening, Havening Therapy, Havening Technique are trademarks and Havening Techniques and Havening Touch are registered trademarks of Ron Ruden, MD, PhD and may only be used with permission from Dr. Ruden ( “Trademarks”). Any unauthorized use of any of the Trademarks is trademark infringement and Dr. Ruden will enforce his legal rights to protect the Trademarks.
  1. Although Havening appears to have promising emotional, mental, and physical health benefits, Havening has yet to be fully researched by the Western academic, medical, and psychological communities and, therefore may be considered experimental. Havening is self-regulated and in the United States and other countries, Havening is considered an alternative or complementary healing method.  Since Havening is a relatively new healing approach and the extent of its effectiveness, as well as Havening’s risks and benefits, are not fully known, you agree to assume and accept full responsibility for any and all risks associated with using Havening and participating in the Event.    
  1. Please be advised by participating in the Event it’s possible to experience some physical discomfort or emotional distress that can be perceived as negative. It is also possible to experience some emotional distress and physical discomfort related to stressful experiences you may have had earlier in your life. You agree to ask for help from the Presenters should your participation in the Event inadvertently activate distressing reactions in you.  If you have questions or concerns about Havening, please feel free to ask the Presenters for further resources
  1. You understand the Event is a hands-on, experiential educational program and is not to be considered treatment for any physical, emotional, or mental disorder nor is participating in the Event a substitute for medical or psychological treatment.  You agree to consult with your health care provider(s) for any specific medical or psychological problems and to continue any medical or psychological treatment that you’re currently receiving. In addition, you understand that any information shared during the Event is not to be considered a recommendation that you stop seeing any of your health care professionals or using prescribed medication, if any, without consulting with your health care professional, even if after using Havening it appears and indicates that such medication or therapy is unnecessary. 
  1. Any stories or testimonials presented during the Event do not constitute a warranty, guarantee, or prediction regarding the outcome of an individual using Havening for any particular purpose or issue. Further, whether the Event is sponsored by CHRT or Trainer, you understand they do not make any warranty, guarantee, or prediction regarding any outcome for you using Havening during or after the Event for any particular purpose or issue.  You agree to take full responsibility for your self-care in the, emotional, mental, physical, and spiritual dimensions of your life and for applying what you may learn from participating in the Event.  Due to the fact that the Event includes group processes in which you may voluntarily reveal personal health information you understand that you waive your rights of privacy and confidentiality. 
  1. You agree and understand the Event includes demonstrations that may be filmed and that CHRT shall have all rights in and to such film, including the copyright therein. If you volunteer to participate in any filmed demonstration, you grant CHRT the right without compensation to you to film, photograph and/or record you while participating in the demonstration and you waive any right which you now have or may have hereafter in  any such film, photograph and/or recording. 
  1. You understand the information presented during the Event, including ideas, suggestions, techniques, training, exercises, instructions, and other materials, is educational in nature and is provided only as general information and is not medical or psychological advice. You acknowledge and agree your participation in the Event is not intended to create nor does it establish a client-practitioner or any other type of professional relationship between you and the Presenters.  Although some of the Presenters may be licensed health care professionals, you agree and understand that they are not providing you with any medical or psychological advice or treatments and being a presenter at the Event is not part of their professional licensed health care practice.
  1. If you are participating in an Event sponsored by CHRT, then any and all matters in dispute between the parties to this Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of State of New York, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted.
  1. You agree and understand this Agreement is intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law. If a court finds any provision of this Agreement is invalid or unenforceable as applied to any circumstance, then the remainder of this Agreement will be interpreted to best carry out the intent of the parties.
  1. You understand that your participation in the Event is strictly voluntary, at your own risk, and that you freely choose to participate. You represent that you’re competent and able to understand the nature and consequences of participating in the Event.  This Agreement shall be binding upon you and your heirs, family, legal representative, successors, and assigns. 
  1. By signing below, you acknowledge that you have carefully and completely read and fully understand all aspects of this Agreement and you agree to all of the terms and conditions stated herein.
  1. For good and valuable consideration, the receipt of which is hereby acknowledged, you and your representative(s) agree to forever, fully release, indemnify, hold harmless, and defend, CHRT, its principals, directors, officers, shareholders, employees, agents, consultants, volunteers, and others associated with CHRT, from any and all claims or liability, of whatsoever kind or nature, and for any damage or injury, including but not limited to, financial, personal, emotional, psychological, medical, or otherwise, which you may incur arising at any time as a result of your use of Havening and your voluntary decision to participate in the Event.
  1. If the event is being sponsored by a Trainer, then for good and valuable consideration, the receipt of which is hereby acknowledged, you and your representative(s) agree to forever, fully release, indemnify, hold harmless, and defend Trainer, his or her, agents, employees, independent contractors,  consultants, volunteers, and others associated with Trainer from any and all claims or liability, of whatsoever kind or nature, and for any damage or injury, including but not limited to, financial, personal, emotional, psychological, medical, or otherwise, which you may incur arising at any time as a result of your use of Havening and your voluntary decision to participate in the Event.

These standards in our workshops, practitioners and trainers represent a level of excellence that will enable our philosophy and techniques to flourish.

Only certified practitioners and trainers may use the logo or trademarks. Delegates who have completed the Havening training but not yet competed their certification are not authorized to use the word Havening in any published material or websites. And they cannot claim to be certified, qualified or anything other than, they have trained and are working toward certification.

These guidelines offer great opportunities for an entrepreneurial individual and recommendations for how we present ourselves to the public.

Intellectual Property Guidelines

Trademarks:

A trademark generally consists of a word, phrase, symbol or a combination of all of them. It can be further defined as a symbol, word, or phrase legally registered or established by use as representing a company or product.

Copyright:

A copyright protects original literary content and is defined as the exclusive legal right, given to an originator or an assignee to print, publish, or record literary, artistic, or musical material, and to authorize others to do the same.

Havening:

Dr. Ronald Ruden through the company Center for Havening Research and Training, Inc. is the registered owner of several trademark applications and registered trademarks world-wide: Havening Technique™, Havening Techniques®, Havening Therapy® stylized, Havening Touch® Stylized, Delta Techniques™.

Requirements:

Center for Havening Research and Training, Inc. fully supports US and international intellectual property rights and requires all certified practitioners to fulfill the moral and legal obligations with respect to our use of copyrighted and trademarked property of Center for Havening Research and Training, Inc. Certified Practitioners of the Havening Techniques must seek permission to use copyrighted works and trademarks whenever appropriate.

Unauthorized use of materials will be taken seriously and addressed appropriately. You may risk your certification status with unauthorized use of Center for Havening Research and Training, Inc. trademark and/or breach of copyright policy.

The authorized users of the trademarks and copyrights owned by Dr. Ronald Ruden and Center for Havening Research and Training, Inc. must certify that they understand this policy and that they will only use the trademarks and any copyrighted materials in an appropriate manner.

Guidance:

Only Certified Havening Practitioners are authorized to use the collateral in the following manner

  1. In all websites, published material etc, the first reference to Havening must include the exact title – Havening Techniques ®
  2. Subsequent use of the word Havening in the document or website should not show the registered trademark symbol ®
  3. Every web page or document that contains the word Havening must display the following footer “Jane Doe and/or XYZ Consulting is a/are certified practitioner(s) of Havening Techniques. Havening Techniques is a registered trade mark of Ronald Ruden, 15 East 91st Street, New York. www.havening.org”
  4. It is not permitted to use the word havening in combination with any other words without corporate approval.
  5. Only certified practitioners and trainers may use the logo or trademarks. Delegates who have completed the Havening training but not yet competed their certification are not authorized to use the word Havening in any published material or websites.
  6. If you have the logo on your site it must also have a link back to www.havening.org
  7. Any videos must be pre-approved by HQ before putting on to the web

Should you wish to use the collateral in any way that is different to the specifications above, please contact corporate headquarters for assistance. We will work with each certified practitioner to ensure that the trademarks and copyrights are used appropriately.

Unauthorized use will put at risk the status of any certified practitioner who continues to use the intellectual property of Center for Havening Research and Training, Inc.

Group Presentations and Introductions to Havening Techniques®

Group presentations and Introductions to Havening Techniques can be used for client acquisition, corporate advising and other endeavors, however content control is paramount to retaining our professional status.

In order to maintain our standards and represent a level of excellence that will enable our philosophy and techniques to flourish, it is vital that presenters have a thorough and comprehensive understanding of the material being shared.

Only Certified Practitioners can be authorized to offer group presentations and introduction to Havening sessions.

Approval for a group presentation of less than an hour in duration can be obtained by emailing info@havening.org, including a submission of your proposed event for each event you go to.

Introductory sessions to Havening Techniques, including the display of slides and performance of a demonstration can only be performed by using the approved standard created by Dr. Steven Ruden. In order to receive approval to use the 2-hour Introduction material, you will be required to submit a 10 minute video evidencing your presentation skills, to ensure that standards are maintained. Alternatively, you may request a Skype session with Dr. Steven Ruden to present to him ‘live’.
